Terms Of Use

All Sales are Commercial Wholesale Only - No Retail Customers.

INITIAL ORDER - Initial order values for new customers (i.e. customers without an established account, web or otherwise) must be equal to or greater than $500 for first orders.

MINIMUM ORDER - Minimum order value for existing customers (those with an established account) is $100 (in material value which excludes any applicable sales tax and/or freight charges).

PRICES - All prices are net and F.O.B. our warehouses and are subject to change based on market fluctuations and availability.

SALES TAX - Industry-Railway Suppliers is required to charge applicable state and local tax on every item for which sales tax exemption certification has not been provided or is not already on file upon ordering. A signed copy of the customer's resale or exemption certificate must be on file to qualify for tax exemption.

PAYMENT TERMS - Industry-Railway Suppliers' payment terms are net upon shipment, payable by Open Account (see below), Visa or MasterCard. Initial credit card authorization will be the total material value plus 10% to allow for any sales taxes or applicable freight charges incurred upon shipment. Actual charges for both sales taxes and freight will be included on the final authorization billing to the customer's credit card. All transactions are in U.S. dollars.

OPEN ACCOUNTS - Open accounts with Industry-Railway Suppliers are available and are based upon prior credit approval. Credit application is available upon request. No COD web orders will be accepted.

FREIGHT CHARGES - All freight charges are F.O.B. shipping point. Freight is to be routed per existing customer routing instructions when applicable, or routed most economical way United Parcel Service on a prepaid and add basis, or LTL freight on a collect basis via carrier of our choice unless otherwise requested.

RETURN GOODS - Return goods authorization is required for any material to be returned. No material will be accepted unless prior return authorization is obtained. Cancellation and or re-stocking charge(s) may apply.

CANCELLATION - Any cancellation of an existing order must be approved by Industry-Railway Suppliers and may be subject to restocking and/or other charges.

LIABILITY - Acceptance of any order is conditioned upon Buyer's acceptance of these terms. WE SHALL NOT BE LIABLE, WHETHER IN CONTRACT, IN TORT, UNDER ANY WARRANTY, IN NEGLIGENCE OR OTHERWISE, FOR CONSEQUENTIAL, SPECIAL OR INCIDENTAL DAMAGES. UNDER NO CIRCUMSTANCES SHALL OUR LIABILITY EXCEED THE AMOUNT OF THE PURCHASE PRICE. THE BUYER'S LIMITED RIGHT TO REPLACEMENT IS THE BUYER'S SOLE AND EXCLUSIVE REMEDY.

LIMITED WARRANTY - Our only obligation is to replace any item proved to be defective. ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE DISCLAIMED.
